1. The basics
These Terms of Service ("Terms") are a legally binding agreement between you ("you" or "customer") and Siren Ai, Inc., a Delaware corporation ("Siren", "we", "us", "our"), the operator of the Siren service at mysiren.ai, app.mysiren.ai, and related subdomains (collectively, the "Service").
By creating an account, connecting an external account, or otherwise using the Service, you agree to these Terms and our Privacy Policy and Cookie Policy and Acceptable Use Policy, which are incorporated here by reference. If you do not agree, do not use the Service.
You must be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher) to use Siren. To purchase a paid subscription, you must be at least 18 and legally able to enter a binding contract.
If you're using Siren on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms, and "you" includes that organisation.
Important: please read Section 16 carefully. It requires most disputes between you and Siren to be resolved through binding individual arbitration rather than in court, and it includes a waiver of class-action and jury-trial rights. You have 30 days from first accepting these Terms to opt out of the arbitration agreement, as described in Section 16.
2. Your account
Creating an account
You create an account with an email and password, or by signing in with Google or X. Your first successful sign-in creates a workspace — the container that owns your Brand DNA, generated assets, connected accounts, and billing status.
Account accuracy
You must provide accurate and current information, including a valid email address we can use to contact you about security, billing, and material changes to the Service.
Account security
You are responsible for keeping your credentials secure, for every action taken through your account, and for notifying us immediately at [email protected] if you suspect unauthorised use.
Team members
Workspace owners may invite other members and assign roles (owner, admin, member). Owners are responsible for what their members do inside the workspace, including the actions of any OAuth connections those members add.
3. Subscription & billing
Plans & pricing
Siren is offered in three tiers: Spark, Pro, and Scale, billed monthly or annually. Current pricing is published at mysiren.ai/pricing and is incorporated into these Terms by reference. Each plan includes a usage allowance (asset generations per month, storage caps, connected-account seats).
Getting started
Signup and onboarding include one complimentary first post. Paid plans (Spark, Pro, and higher) begin when you subscribe via Stripe; we will not charge you without prior notice at the email on file.
Auto-renewal
Paid subscriptions renew automatically at the end of each billing period (monthly or annual) for the same term at the then-current rate. You may cancel at any time from your workspace settings; cancellation takes effect at the end of the current paid period.
Refunds
30-day refund on request. Within 30 days of any paid charge (monthly or annual), email [email protected] with your account email and we'll refund that charge in full, no questions asked. You can ask for any reason — wrong plan, didn't use it, didn't like it, business changed. We'd rather give your money back than have you stuck on a tier that doesn't fit.
After the 30-day window, paid periods are non-refundable except where required by applicable consumer-protection law (including the EU 14-day withdrawal right, which we honour for purchases made by EU-resident consumers provided the Service has not been substantially used during the withdrawal window). Prorated refunds for downgrades are issued as account credit.
Annual plans cancelled within the first 30 days receive a full refund. After 30 days, annual plans are refunded prorated for the unused months — Stripe issues the refund on cancellation, and access to paid features ends at the same time.
Taxes
Listed prices do not include VAT, GST, sales, or other applicable taxes, which we will add at checkout where required. You are responsible for any taxes arising from your use of the Service that are not collected by us.
Currency & payment
Charges are billed in US Dollars through our payment processor (Stripe). Failed payments may result in service suspension or cancellation after reasonable notice and retry attempts.
Price changes
We may change pricing from time to time. For existing paid customers, any price increase takes effect at the start of the next renewal term, and we'll give you at least 30 days' email notice before it applies.
4. What you can do with Siren
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service to:
- Set up a Brand DNA profile (archetype, colors, fonts, tagline, banned topics).
- Submit briefs and generate on-brand marketing assets (cards, videos, carousels, infographics, OG images, and other asset types we may add).
- Store, preview, and download generated assets subject to your plan's limits.
- Connect external posting accounts (X, LinkedIn, Instagram, YouTube, TikTok, etc.) and dispatch generated assets to those accounts.
- Invite members of your team to your workspace and manage their access.
The commercial rights attached to your generated outputs are described in Section 6.
Changes to the Service
We may add, modify, suspend, or discontinue features of the Service (or the Service as a whole) at any time. Where a change materially reduces the capability of a paid plan, we will give affected customers at least 30 days' email notice. To the maximum extent permitted by law, we are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
Support
We provide support by email and through our published documentation. We have no obligation to provide maintenance, custom development, or a guaranteed response time unless a separate written agreement with your workspace says otherwise.
5. Acceptable use
You agree not to use the Service to create, post, distribute, or store content that:
- Is illegal under the law of any jurisdiction where you operate or where the content is distributed.
- Infringes the intellectual-property, privacy, publicity, or contract rights of any third party.
- Is defamatory, fraudulent, threatening, harassing, or discriminatory on the basis of a protected characteristic.
- Promotes violence, self-harm, terrorism, or the sexual exploitation of minors.
- Constitutes unsolicited bulk commercial communication (spam) in violation of CAN-SPAM, GDPR, PECR, CASL, or comparable laws.
- Impersonates a real person, brand, or organisation without that party's authorisation.
- Constitutes a "deepfake" of a real individual without that individual's informed consent.
- Is designed to deceive voters about the time, place, or manner of an election, or to suppress participation in democratic processes.
- Promotes financial products, ICOs, securities, or loans in a manner that violates applicable securities law.
- Circumvents content moderation, rate limits, or the Reasoner quality gate through prompt injection, output stripping, or other adversarial techniques.
- Attempts to extract, reverse-engineer, or benchmark our underlying models, or to train a competing AI model on our outputs.
- Automates access to the Service beyond the rate limits and API terms we publish.
- Interferes with the security, integrity, or availability of the Service (including unauthorised scanning, penetration testing without prior written approval, or overwhelming the infrastructure).
We may investigate suspected violations and remove content, suspend features, or terminate accounts at our reasonable discretion. Serious or repeat violations may be reported to the relevant authorities.
6. Your content & our content
Your content
"Your Content" means everything you submit to the Service: briefs, Brand DNA inputs, uploaded logos, mascots, and source material, plus any feedback you give us about outputs.
You retain all ownership rights in Your Content. By submitting it, you grant us a worldwide, royalty-free licence to host, reproduce, transmit, and process Your Content for the strict purpose of operating and improving the Service for you - including sending it to our LLM subprocessors (see Section 8) to generate outputs, and storing embeddings of high-scoring outputs in your workspace's Brand Memory so future generations can reference them.
Subject to your opt-out preference, we may use Your Content to improve Siren's own AI models. Fine-tuning our Reasoner, quality scorer, and design-judgment evaluator. We do not share Your Content with any third party for their training, and we do not sell it. Our AI model provider does not train on data sent through its paid API (per their published terms. Not something we control); Brand Memory embeddings are computed locally on our own infrastructure. You can opt out at any time in your account at app.mysiren.ai/app/settings under "Privacy & Data". See Section 9 for the full training-data position.
Generated outputs
Subject to your compliance with these Terms and payment of applicable fees, we assign to you all rights we can legally assign in the outputs Siren generates specifically for your workspace (the copy, the rendered images, the rendered videos, the rendered carousels, etc.). With the following caveats that apply to any generative-AI output:
- No uniqueness guarantee. The underlying models are probabilistic. Another customer could submit a similar brief and receive a similar output. We make no warranty that any particular output is original, novel, or non-obvious.
- Limited copyright protection. The copyright status of AI-generated content is unsettled and varies by jurisdiction. In the United States, the Copyright Office has taken the position that purely AI-generated content is not protectable by copyright absent sufficient human creative input. We make no representation as to whether any specific output is copyrightable.
- Third-party rights. You are responsible for ensuring outputs you publish do not infringe third-party trademarks, name/likeness rights, or other intellectual-property rights. Especially for outputs that incorporate public figures, well-known brands, or copyrighted material referenced in your brief.
Our content
The Service itself. The software, the rendering pipeline, the Reasoner scoring system, the Brand Memory architecture, the dashboard UI, our trademarks, and our documentation. Is owned by Siren Ai, Inc. and our licensors. We grant no licence to our content beyond what these Terms expressly describe.
Feedback
If you send us feedback, suggestions, or feature requests, we may use them without obligation to you. You grant us a perpetual, royalty-free licence to act on that feedback.
7. Connected accounts & posting
You may connect external accounts (X, LinkedIn, Instagram, YouTube, TikTok, Facebook, and others we support) through OAuth so Siren can post generated assets on your behalf. When you do this:
- We store your access and refresh tokens encrypted at rest.
- We only take actions you explicitly initiate. You press the "Post" button on a specific approved run. We do not post autonomously without your action.
- You remain fully responsible for the content you dispatch to those accounts, for compliance with each platform's own Terms of Service and community guidelines, and for any consequences of the post.
- You can disconnect a connected account at any time from the Connected Accounts page, which revokes our access.
Each third-party platform is independent of Siren. We are not liable for actions those platforms take in response to your posts (shadowbans, takedowns, suspensions, algorithm changes), nor for their service availability.
8. Third-party services & subprocessors
Siren is built on top of a small set of third-party services. The current list (subject to updates via the change process in Section 19) is:
| Provider | Purpose | Data processed |
|---|---|---|
| AI model provider (via OpenRouter) | Copy generation and brand checks | Prompts, Brand DNA, generated copy |
| fal.ai | Painting stills and generating music | Image prompts built from your prompt and Brand DNA, your logo and reference images |
| Cartesia | Voice-over for narrated videos | Narration script text |
| Cloudflare R2 | Asset storage (PNG/MP4) | Generated asset files, workspace-partitioned |
| Cloudflare (DNS/CDN) | Domain routing, public asset delivery | Request metadata (IP, user-agent) for network-layer operations |
| Contabo | Application & database hosting (Sage VPS) | All application data at rest |
| Resend | Transactional email | Recipient email, message body |
| terms.sections.thirdParty.table.rows.sentry.provider | terms.sections.thirdParty.table.rows.sentry.purpose | terms.sections.thirdParty.table.rows.sentry.data |
| Stripe | Payment processing | Payment method, billing details. Stripe processes as a data controller for its own fraud/compliance purposes |
| X, LinkedIn, Instagram, YouTube, TikTok, Facebook | Destination platforms for posting | Content you explicitly dispatch, plus OAuth account identifiers |
Each subprocessor is bound by its own Terms and Privacy Policy, to which you are not a direct party. We have selected providers that we believe offer appropriate technical and organisational measures, but we cannot warrant their individual service levels.
Your interactions with third-party platforms and services (including the destination platforms you post to) are solely between you and those third parties, under their own terms. To the fullest extent permitted by law, you release Siren Ai, Inc., its officers, employees, agents, successors, and assigns from all claims, demands, and damages arising out of or related to those third-party services — including a platform suspending your account, changing its API, or removing your content. If you are a California resident, you waive California Civil Code Section 1542, which provides: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her would have materially affected his or her settlement with the debtor or released party."
9. AI disclaimers
Siren is a generative-AI product. That comes with specific disclosures we want to make loud and clear, not bury.
Training data. What we do with your content (opt-out controlled)
We are building Siren toward a long-term goal: a design-judgment system trained on real customer outcomes. Which voices land, which fail, which audiences respond. By default ("opted in"), Your Content may be used to improve Siren's own models. Specifically:
- Your briefs, generated SirenSeeds, renders, and outcome signals (whether you rerolled, tweaked, posted, what engagement signals returned after you posted) may be incorporated into a training corpus.
- We use that corpus to fine-tune our Reasoner and quality scorer. The corpus stays inside Siren. We never share it with third parties for their training, and we never sell it.
- Our AI model provider does not train on data sent through its paid API. That's per their public terms, not something we control. Brand Memory embeddings are computed by a local model on our own infrastructure and never leave our network.
You can opt out anytime in your account at app.mysiren.ai/app/settings under "Privacy & Data". Opting out:
- Excludes your future Content from any Siren training corpus.
- Does not affect existing renders or operational data (we keep Your Content to serve it back to you and to satisfy our own data-retention obligations).
- Has no effect on your subscription, features, or quotas.
We do always store your briefs and outputs as part of delivering the Service (so you can view past campaigns, and so the Brand Memory component can fetch similar successful outputs to inject into future prompts for your workspace only). See our Privacy Policy for the full data-retention picture.
Hallucinations, bias, and factual errors
Large language models can produce content that sounds confident but is factually wrong, misattributed, or reflects biases present in training data. You are responsible for reviewing every output before publishing it. Siren's Reasoner quality gate scores outputs but does not guarantee factual accuracy, legal compliance, or cultural appropriateness.
Output responsibility
You. Not Siren. Decide whether, when, and where to publish an output. The Reasoner's "approved" status is a quality heuristic, not a legal or editorial sign-off. If an output contains a claim about a product, person, event, or statistic that you cannot personally verify, do not publish it.
Third-party content in outputs
If your brief explicitly references a real person, brand, or work, the model may produce an output that incorporates name, likeness, or trademarked phrasing. You are responsible for having the legal right to reference those third parties in the context of the output.
No professional advice
Nothing Siren generates is legal, medical, financial, tax, or professional advice. Outputs that read like advice are generated text, not a professional opinion.
Model & provider changes
We may switch between model providers or model versions to improve quality, reduce latency, or manage cost. Different models produce different outputs for the same brief; we do not guarantee any particular model will be used or remain available.
10. Intellectual property
Subject to Section 6, all rights in the Siren platform, including its software, pipeline architecture, scoring system, design system, templates, BGM audio, logos, and branding are owned by Siren Ai, Inc. or its licensors.
You grant us no licence in your trademarks beyond the scope required to render them inside your own generated assets. Where you supply a logo as part of Brand DNA, you represent that you have the right to use it and to authorise us to render it into generated outputs for your workspace.
If you believe content on the Service infringes your copyright, send a DMCA-style notice to [email protected] with the information required under 17 U.S.C. § 512(c)(3).
11. Confidentiality
Each party will protect the other's confidential information with the same care it uses for its own confidential information of like kind (and no less than reasonable care). Confidential information means non-public business or technical information marked confidential or that a reasonable person would understand to be confidential given the circumstances.
Your briefs, Brand DNA, and generated outputs are confidential to you. Our non-public pricing, roadmap, and internal scoring heuristics are confidential to us.
Confidentiality obligations do not apply to information that is or becomes publicly available through no fault of the receiving party, was already known without obligation of confidence, is independently developed, or is rightfully received from a third party without restriction.
12. Termination
Termination by you
You may cancel your subscription or delete your workspace at any time from your workspace settings. Cancellation takes effect at the end of the current paid period; deletion is effective immediately (and is irreversible. See retention below).
Termination by us
We may suspend or terminate your access immediately if you materially breach these Terms (including violating Section 5), or with reasonable notice for convenience. We'll try to give you at least 30 days' notice before a for-convenience termination unless urgency demands otherwise.
Effect of termination
On termination, your right to use the Service ends immediately. We will retain your workspace data for up to 30 days to allow you to export it on request, after which we will delete it from our active systems. Backups containing terminated workspaces are rotated out of our systems within 90 days.
Survival
Sections 6 (your outputs already assigned), 9–11, 13–18, and any accrued payment obligations survive termination.
13. Warranty disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, title, quiet enjoyment, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, error-free, secure against every attack, or that generated outputs will meet your requirements or be suitable for any particular use. Some jurisdictions do not allow the exclusion of implied warranties; in those jurisdictions, the above exclusion applies to the maximum extent permitted.
Where applicable law does not allow us to disclaim an implied warranty, that warranty is limited in duration to 90 days from your first use of the Service, to the extent such a limitation is permitted.
14. Limitation of liability
To the maximum extent permitted by law:
- Neither party will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data, arising out of or related to these Terms or the Service, even if advised of the possibility.
- Each party's aggregate liability arising out of or related to these Terms will not exceed the greater of (a) the amounts you paid us in the 12 months before the event giving rise to the liability, or (b) US$100.
These limitations do not apply to: (i) either party's indemnification obligations; (ii) your payment obligations; (iii) either party's gross negligence, fraud, or wilful misconduct; or (iv) any liability that cannot be limited by applicable law.
15. Indemnification
You will defend, indemnify, and hold harmless Siren Ai, Inc. and its affiliates, officers, employees, and agents from and against any third-party claim, demand, loss, or damage (including reasonable legal fees) arising out of or related to:
- Your Content, including any Brand DNA material you upload;
- Any content you publish or transmit via connected accounts through Siren;
- Your breach of these Terms, including Section 5;
- Your violation of applicable law or the rights of any third party.
We will defend, indemnify, and hold harmless you against any third-party claim alleging that the unmodified Service, as provided by us and used in accordance with these Terms, infringes that party's US copyright, US patent, or US trademark. This is our sole liability for infringement claims, subject to Section 14.
16. Disputes, arbitration & governing law
Governing law
These Terms and any dispute arising out of or related to them or the Service are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, and by the Federal Arbitration Act with respect to the arbitration agreement below.
Try to resolve it with us first
Before starting arbitration or any formal proceeding, the party raising a dispute will send written notice to the other (for notices to us: [email protected], from the email address on your account) and the parties will make a good-faith effort to resolve the dispute informally for at least 30 days. If the dispute is not resolved within 60 days of that notice, either party may proceed under this Section.
Binding individual arbitration
Except for the carve-outs below, you and Siren agree to resolve all disputes arising out of or relating to the Service or these Terms — including questions of formation, breach, termination, validity, and arbitrability — through binding individual arbitration, not in court. Arbitration is administered by JAMS (jamsadr.com): claims under US$250,000 (excluding fees and interest) under the JAMS Streamlined Arbitration Rules, larger claims under the JAMS Comprehensive Arbitration Rules. Unless the parties agree otherwise, the arbitration will be conducted in the county where you live, by video, or on the papers. The arbitrator may award the same relief a court could, on an individual basis only, and the award is final and binding; judgment may be entered in any court with jurisdiction. All arbitration materials are confidential.
Carve-outs
Either party may (i) bring an individual action in small-claims court for claims within that court's limits, and (ii) seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual-property rights. For any claim not subject to arbitration, the parties submit to the exclusive jurisdiction and venue of the state and federal courts of Delaware.
Jury-trial waiver
By agreeing to arbitration, you and Siren waive the right to a trial by judge or jury for all covered claims.
Class-action waiver
All disputes must be brought on an individual basis. Neither you nor Siren may bring claims as a plaintiff or class member in any class, representative, or collective proceeding, and the arbitrator may award relief only on an individual basis. If a court finds this class-action waiver unenforceable as to a specific claim, that claim may be litigated in the courts of Delaware; all other claims remain subject to arbitration.
Fees
Each party bears its own attorneys' fees unless the arbitrator finds a claim was frivolous or brought for an improper purpose, or applicable law or the JAMS rules provide otherwise.
Batch arbitration
If 100 or more substantially similar arbitration demands are filed against Siren within a 30-day period by the same or coordinated counsel, they will be administered in batches of up to 100, with one arbitrator and one set of fees per batch, as the JAMS mass-arbitration procedures provide.
Your 30-day right to opt out
You may opt out of this arbitration agreement (including the class-action waiver) within 30 days of first accepting these Terms by emailing [email protected] with your full name, your account email, and a clear statement that you wish to opt out. Opting out does not affect any other part of these Terms, and future material changes to this Section restart your 30-day opt-out window.
Nothing in this Section limits the rights of consumers in the European Union or the United Kingdom to bring a dispute before the courts of their country of residence, or to rely on mandatory consumer-protection law, where those rights cannot be waived by contract.
If any part of this arbitration agreement is found invalid or unenforceable, it will be modified to the minimum extent necessary to be enforceable, and the remainder stays in effect.
17. US state notices
The notices in this Section apply only to users to the extent they are subject to the laws of the states identified. If a notice here conflicts with another provision of these Terms, the state-specific notice controls for users subject to that state's laws.
California
Under California Civil Code Section 1789.3, California users are entitled to the following consumer-rights notice: the Service is provided by Siren Ai, Inc., 2810 N Church St STE 89663, Wilmington, DE 19802, reachable at [email protected]. Complaints about the Service, or requests for further information, may be sent to that postal address or email. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 N. Market Blvd., Suite N-112, Sacramento, CA 95834, or by phone at (800) 952-5210. California residents have additional rights under the CCPA/CPRA — see Section 14 of our Privacy Policy.
Nevada
Under Nevada Revised Statutes Chapter 603A, Nevada residents may direct us not to sell certain covered information we have collected or will collect about them. We do not sell covered information. Nevada residents may register a preference for the future at any time by emailing [email protected].
Other states
Residents of Colorado, Connecticut, Virginia, Texas, Oregon, Montana, and other states with comprehensive privacy laws may have rights of access, correction, deletion, portability, and opt-out of sale, targeted advertising, or profiling. How to exercise them is described in our Privacy Policy.
18. General
Export control
You may not use, export, re-export, or transfer the Service or any technical data obtained from it in violation of US export-control laws or sanctions regulations (including those administered by OFAC), or the applicable laws of any other jurisdiction. You represent that you are not located in, organised in, or a resident of an embargoed country or region, and are not on any US government restricted-party list.
Electronic communications
By using the Service, you consent to receive communications from us electronically — by email to the address on your account or by notices posted in the dashboard or on our sites. You agree that these electronic communications satisfy any legal requirement that a communication be in writing.
Accessibility
We aim to make the Service accessible to all users, including people with disabilities, and we work toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. If you have difficulty accessing any part of the Service, or suggestions for improving accessibility, contact us at [email protected] and we will make reasonable efforts to help.
Entire agreement & construction
These Terms, together with the Privacy Policy, Cookie Policy, Acceptable Use Policy, and any order form or written agreement referencing them, are the entire agreement between you and Siren about the Service, and supersede any prior understandings. If any provision is found invalid or unenforceable, it will be modified to the minimum extent necessary and the rest remains in effect. Our failure to enforce a provision is not a waiver of it. "Including" means "including without limitation". You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, reorganisation, or sale of assets. These Terms bind and benefit permitted successors and assigns. There are no third-party beneficiaries.
Copyright © 2026 Siren Ai, Inc. All rights reserved. All trademarks, logos, and service marks displayed on the Service are the property of Siren Ai, Inc. or of third parties; you may not use any of them without the owner's prior written consent.
19. Changes to these terms
We may update these Terms from time to time. For material changes (including anything affecting pricing, data use, liability, or subprocessor composition), we will give affected customers at least 30 days' email notice before the changes take effect. Your continued use of the Service after the effective date means you accept the updated Terms; if you don't accept, you may cancel before that date for a prorated refund of prepaid, unused fees.
Non-material changes (typos, clarifications, updated subprocessor contact details) take effect on posting; the "last updated" timestamp at the top of this page is authoritative.
